2. Federal rights do not disappear at the state line

Child Find

Public agencies must identify, locate and evaluate children with disabilities who may need special education and related services.

IEP, FAPE and LRE

Eligible students retain the federal IDEA framework even where Rhode Island adds faster timelines or extra safeguards.

Section 504 and ADA

Federal nondiscrimination rights can apply independently of IDEA eligibility.

3. File an IDEA state complaint in Rhode Island

Rhode Island Department of Education administers the state-level IDEA complaint process. A complaint generally must allege a violation within the federal one-year lookback and a copy must be sent to the school district/public agency at the same time. Federal rules generally require a written decision within 60 days, subject to limited extensions.

4. Restraint and seclusion: Rhode Island

State education guidance / child-service statutes: RIDE restraint/seclusion guidance and local policy; R.I. Gen. Laws ch. 42-72.9 for covered child-service settings

Rhode Island uses education guidance and local policy alongside broader state protections. For a school incident, obtain the current RIDE/district policy and check whether disability, special-education or child-service rules add protections.

For infants and toddlers, the Part C lead agency coordinates evaluation, eligibility and IFSP services. Federal Part C generally uses a 45-day post-referral timeline for the initial evaluation/assessment and initial IFSP meeting, subject to regulatory exceptions. State eligibility definitions, referral pathways and service-coordination structures differ.

6. Medicaid in Rhode Island

Appeal / fair-hearing officeRhode Island EOHHS Appeals

Apply through the state Medicaid route and ask the agency to screen for every disability-related eligibility category that may apply, including HCBS waiver pathways and any state TEFRA/Katie Beckett option. Eligibility rules and waiting lists are state-specific.

For Medicaid-enrolled people under 21, EPSDT can require medically necessary services within federal Medicaid benefit categories to correct or ameliorate a condition. If eligibility, a service, amount, duration or authorization is denied or reduced, read the notice immediately: appeal and continuation-of-benefits deadlines can be short and may depend on who made the decision.

9. Build the case file

  1. Save the current state procedural safeguards.
  2. Record the exact evaluation clock and start event.
  3. Keep a dated chronology of requests, consent, meetings, decisions and missed services.
  4. For restraint/seclusion, preserve incident reports, medical evidence, witness accounts, video requests and training/policy records.
  5. For Medicaid, save every eligibility, authorization and denial notice plus the deadline printed on it.
  6. Use the correct forum. IDEA complaint, due process, OCR, state restraint complaint channels and Medicaid fair hearings solve different issues.

13. Final state verification checklist

State action routes and legal/program layer reviewed 24 August 2026. Part C contacts were cross-checked against ECTA's August 2026 Part C state directory. Medicaid application routes were checked against CMS/state agency routes. HCBS names are selected examples, not an exhaustive list. 2026 OSEP determinations are state-system monitoring categories and do not decide an individual child’s case.
