Five layers families may be dealing with at once

  1. Federal education law. IDEA Part B governs special education for eligible children and youth. IDEA Part C covers early intervention for infants and toddlers.
  2. Federal civil-rights law. Section 504 and the ADA can protect disabled students even where IDEA eligibility is not established.
  3. State implementation. States set many procedural details, operate complaint systems and may use different evaluation clocks or earlier transition ages.
  4. Federal benefits administered through national rules. SSI is run by Social Security, but state supplements and Medicaid interactions can still differ.
  5. State healthcare and disability systems. Medicaid, CHIP, HCBS waivers, managed-care plans, developmental-disability agencies and waiting lists vary substantially.

Start with the problem, not the acronym

School is not identifying or assessing need

Start with Child Find, a written evaluation request, consent rules and your state evaluation clock.

The IEP exists but is not happening

Document missed services. Consider an IEP meeting, Prior Written Notice, a state IDEA complaint, mediation or due process depending on the dispute.

Healthcare or disability support was denied

Read the denial notice, identify whether Medicaid or a managed-care plan made the decision, and protect the appeal/fair-hearing deadline.
