2. Federal rights do not disappear at the state line

3. File an IDEA state complaint in Maryland

Maryland State Department of Education administers the state-level IDEA complaint process. A complaint generally must allege a violation within the federal one-year lookback and a copy must be sent to the school district/public agency at the same time. Federal rules generally require a written decision within 60 days, subject to limited extensions.

4. Restraint and seclusion: Maryland

State statute and regulation: Md. Educ. Code §§ 7-1101 et seq.; COMAR 13A.08.04

Maryland restricts physical restraint to imminent serious physical harm after less intrusive interventions fail. Seclusion is prohibited in public agencies, with narrower rules for certain nonpublic schools. Parent notice and detailed documentation are required.

For infants and toddlers, the Part C lead agency coordinates evaluation, eligibility and IFSP services. Federal Part C generally uses a 45-day post-referral timeline for the initial evaluation/assessment and initial IFSP meeting, subject to regulatory exceptions. Apply through the state Medicaid route and ask the agency to screen for every disability-related eligibility category that may apply, including HCBS waiver pathways and any state TEFRA/Katie Beckett option. Eligibility rules and waiting lists are state-specific.

For Medicaid-enrolled people under 21, EPSDT can require medically necessary services within federal Medicaid benefit categories to correct or ameliorate a condition. If eligibility, a service, amount, duration or authorization is denied or reduced, read the notice immediately: appeal and continuation-of-benefits deadlines can be short and may depend on who made the decision.
